These Terms & Conditions apply to purchases made through the online store available at www.pateabotanica.com.

1. Seller Information

The seller is a company registered in the Czech Republic and operates the Patéa Botanica brand.

2. Scope of These Terms

These Terms & Conditions govern the rights and obligations between the seller and the customer arising from the purchase of goods through the online store.

By placing an order, the customer confirms that they have read and agreed to these Terms & Conditions.

These Terms & Conditions apply to both consumers and business customers, unless stated otherwise. A consumer is a natural person who purchases goods outside their business or professional activity.

3. Products and Product Information

The online store offers cosmetic products, hair care products, scalp care products, accessories and related goods under the Patéa Botanica brand.

All product information, including descriptions, ingredients, usage instructions, volume and main characteristics, is provided on the product pages.

The seller makes every effort to ensure that product descriptions, images and prices are accurate. However, product packaging, design or ingredients may change where required by production, legal or regulatory reasons. The customer should always follow the information provided on the product packaging.

Product images are for illustrative purposes and may slightly differ from the actual product.

4. Prices

All prices are shown in the currency displayed in the online store.

Prices include VAT where applicable, unless stated otherwise.

Shipping costs, duties, customs fees or other charges may be added depending on the delivery country and chosen shipping method. These costs are shown during checkout where available.

The seller reserves the right to change prices at any time. The price valid at the time of order confirmation applies to the customer’s order.

In the event of an obvious technical or pricing error, the seller is not obliged to deliver the goods at the incorrect price. The customer will be informed without undue delay and may either accept the corrected price or cancel the order.

5. Order and Contract Formation

The customer places an order by adding products to the cart, completing the checkout form and confirming the order.

Before submitting the order, the customer may review and correct the entered information.

After the order is placed, the customer receives an automatic order confirmation by email. This confirms that the order has been received.

The purchase contract is concluded once the seller accepts the order and confirms its processing.

The seller reserves the right to refuse or cancel an order, especially if:

  • the product is unavailable,
  • payment is not completed,
  • the order contains incorrect or incomplete information,
  • there is a suspected misuse of the online store,
  • there is an obvious technical or pricing error.

If the seller cannot fulfil the order, the customer will be informed and any payment already received will be refunded.

6. Customer Account

The customer may create a customer account, if this function is available in the online store.

The customer is responsible for providing accurate and up-to-date information and for keeping login details confidential.

The seller is not responsible for misuse of the customer account caused by the customer’s failure to protect login details.

The seller may suspend or cancel a customer account if the customer violates these Terms & Conditions or misuses the online store.

7. Payment

The available payment methods are displayed during checkout.

Payment may include, depending on availability:

  • payment card,
  • bank transfer,
  • online payment gateway,
  • other payment methods offered in the online store.

The order is processed after successful payment unless cash on delivery or another payment method is offered and selected.

In the case of online payment, the customer follows the instructions of the relevant payment provider.

8. Shipping and Delivery

Goods are delivered to the address provided by the customer during checkout.

Available delivery methods, delivery countries, estimated delivery times and shipping costs are displayed during checkout or in the Shipping Policy.

The customer is responsible for entering a complete and correct delivery address.

If delivery fails due to incorrect information provided by the customer, refusal to accept the package or failure to collect the shipment, the seller may charge the customer for additional shipping costs.

The customer is advised to check the shipment upon delivery. If the package is visibly damaged, the customer should report this to the carrier immediately and contact the seller.

Ownership of the goods passes to the customer after full payment and delivery. The risk of accidental loss or damage passes to the customer upon receipt of the goods.

9. Right of Withdrawal

If the customer is a consumer, they have the right to withdraw from the purchase contract within 14 days without giving any reason.

The withdrawal period expires 14 days after the day on which the customer, or a third party indicated by the customer, receives the goods.

In the case of an order containing several goods delivered separately, the withdrawal period expires 14 days after the day on which the customer receives the last item.

To exercise the right of withdrawal, the customer must inform the seller by a clear statement sent to:

The customer may use a withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for the customer to send the withdrawal notice before the withdrawal period expires.

10. Exceptions to the Right of Withdrawal

The customer cannot withdraw from the contract in cases provided by applicable law.

For cosmetic and personal care products, the right of withdrawal does not apply especially to goods delivered in sealed packaging which have been opened after delivery and cannot be returned for health protection or hygiene reasons.

This applies in particular to opened cosmetic products, scalp care products, hair care products and other personal care products where the protective seal or original packaging has been removed or damaged.

11. Returns After Withdrawal

If the customer withdraws from the contract, they must return the goods to the seller within 14 days from the day they informed the seller about the withdrawal.

Returned goods must be unused, undamaged, complete and, where applicable, in the original sealed packaging.

The customer bears the direct cost of returning the goods, unless stated otherwise by the seller.

The seller may refuse to refund opened cosmetic or personal care products if they cannot be returned for hygiene or health protection reasons.

The seller will refund the customer within 14 days from receiving the withdrawal notice. However, the seller may withhold the refund until the goods have been received back or until the customer provides proof that the goods have been sent back.

Refunds are made using the same payment method used by the customer, unless agreed otherwise.

If the customer chose a delivery method other than the least expensive standard delivery offered by the seller, the seller will refund only the cost of the least expensive standard delivery.

12. Complaints and Defective Goods

The seller is responsible for delivering goods without defects and in conformity with the purchase contract.

If the goods are defective, damaged or not in conformity with the order, the customer should contact the seller without undue delay at:

The complaint should include:

  • order number,
  • description of the defect,
  • photographs where relevant,
  • customer contact details.

The customer may be entitled to repair, replacement, reasonable discount or withdrawal from the contract, depending on the nature of the defect and applicable law.

Complaints are handled in accordance with Czech law and applicable EU consumer protection rules.

Consumer complaints will be handled without undue delay, no later than within 30 days from the date of the complaint, unless the seller and the customer agree on a longer period.

The seller will inform the customer about the result of the complaint by email.

13. Use of Products

The customer must use the products according to the instructions provided on the packaging or in the product description.

Cosmetic products are intended for external use only, unless expressly stated otherwise.

The seller is not responsible for damage caused by incorrect use, allergic reaction, misuse, improper storage or use contrary to the instructions.

If the customer has sensitive skin, allergies, a medical condition or is unsure whether a product is suitable, they should consult a qualified professional before use.

Patéa Botanica products are cosmetic products. Product descriptions, educational content and marketing materials are provided for informational purposes only and are not intended to diagnose, treat, cure or prevent any disease. Individual results may vary.

14. Intellectual Property

All content on the online store, including texts, photographs, graphics, product names, brand elements, logos, design and layout, is protected by intellectual property rights.

The Patéa Botanica brand, product names, visual identity and related content may not be copied, reproduced, modified or used without the seller’s prior written consent.

15. Reviews and User Content

If customers submit reviews, comments, photographs or other content, they confirm that the content is truthful, lawful and does not infringe the rights of third parties.

The seller may use customer reviews or submitted content for marketing purposes only where permitted by law and, where necessary, with the customer’s consent.

The seller reserves the right not to publish or to remove content that is misleading, offensive, unlawful or unrelated to the product.

16. Discounts and Promotional Codes

Discounts, promotional codes and special offers are valid only under the conditions stated for each promotion.

Unless expressly stated otherwise, discounts cannot be combined.

The seller may cancel a discount or promotional code in the event of misuse, technical error or violation of the promotional conditions.

17. Limitation of Liability

The seller is not liable for interruptions of the online store caused by technical maintenance, third-party service providers, internet outages or force majeure.

The seller is not liable for damage caused by improper use of products or by circumstances beyond the seller’s reasonable control.

Nothing in these Terms & Conditions limits the customer’s mandatory consumer rights under applicable law.

18. Personal Data

The seller processes personal data in accordance with applicable data protection laws, including the GDPR.

Information about the processing of personal data is provided in the Privacy Policy available on the online store.

19. Alternative Dispute Resolution

If the customer is a consumer and a dispute cannot be resolved directly with the seller, the customer may contact the competent authority for alternative dispute resolution.

Consumers may also use relevant European consumer support services where applicable.

20. Governing Law

These Terms & Conditions and the purchase contract are governed by the laws of the Czech Republic.

If the customer is a consumer residing in another EU country, this choice of law does not deprive the customer of the protection granted by mandatory consumer protection laws of their country of residence.

21. Final Provisions

The seller may amend these Terms & Conditions at any time. The version applicable to the customer’s order is the version valid at the time the order was placed.

The purchase contract, including these Terms & Conditions, is archived electronically by the seller.

If any provision of these Terms & Conditions is invalid or unenforceable, the remaining provisions remain valid.

These Terms & Conditions become effective on the date stated above.
